These Horizon3.ai Community Terms & Conditions (the “Community Terms”) govern your access to and use of any community spaces, forums, discussion boards, user groups, events, and related collaboration channels offered or hosted by Horizon3 AI, Inc. (“Horizon3.ai,” “we,” “us,” or “our”) in connection with its products and services (collectively, the “Community”). By accessing or using the Community, you agree to be bound by these Community Terms, our Terms of Service (the “Site Terms”) and our Privacy Policy. If there is a conflict between these Community Terms and the Site Terms solely with respect to your Community use, these Community Terms will control.
1. Eligibility and Account
- Eligibility. You may use the Community only if you (a) are at least the age of majority in your place of residence, and (b) have the legal capacity and authority to enter into these Community Terms, including on behalf of your employer or organization if you are using the Community in a professional capacity.
- Account and Access. You may be required to create an account or use existing credentials (for example, your Horizon3.ai account or single sign‑on provider) to access portions of the Community. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- No Multiple Accounts. You may not create, maintain, or use multiple Community accounts for the same individual. If Horizon3.ai determines that duplicate or fraudulent accounts exist, Horizon3.ai may suspend or terminate some or all such accounts.
2. General Code of Conduct
The Community is intended to foster collaboration, learning, and knowledge sharing related to Horizon3.ai products, services, cybersecurity, and related topics. To maintain a positive, safe, and productive environment for all participants, you agree to comply with the following code of conduct:
2.1 Be Friendly and Respectful
Treat all participants with respect, professionalism, and courtesy. Do not post or share any content that is racist, sexist, discriminatory, harassing, defamatory, obscene, hateful, threatening, or otherwise offensive or inappropriate. Do not use coarse language, slurs, or make inappropriate jokes at the expense of others, and do not engage in bullying, intimidation, doxxing, or personal attacks.2.2 Stay Legal and Compliant
Do not post, upload, or share any content that is unlawful, that you do not have the right to disclose, or that infringes, misappropriates, or violates any intellectual property, privacy, publicity, or other rights of any person or entity. Do not post or link to pornographic, sexually explicit, or otherwise offensive material, including content that promotes violence, self‑harm, or illegal activities. Do not distribute malware, viruses, worms, trojan horses, spyware, or any other malicious code, or engage in any activity that seeks unauthorized access to, or interferes with, the operation of any system or network. Do not use the Community to promote or participate in any unlawful, fraudulent, or deceptive scheme, including but not limited to unauthorized penetration testing or security testing of systems you are not authorized to test.2.3 Stay On Topic
Keep your contributions relevant to the topic and to the purpose of the Community. Avoid “hijacking” threads with unrelated discussions. Refrain from persistent off‑topic posting, spamming, flooding, or otherwise disrupting conversations. Horizon3.ai may move, edit, or remove content that is off‑topic or inappropriate for a particular Community area.2.4 No Commercial Use or Solicitation
The Community is not a marketplace. You may not use the Community to advertise, promote, or sell products or services, or to solicit business, donations, or investment, except where Horizon3.ai has explicitly enabled such activity. Do not send unauthorized or unsolicited commercial messages (“spam”) to Community members, including via private message. Do not use the Community to promote or advertise other communities, forums, websites, or events that are unrelated to Horizon3.ai, unless expressly permitted by Horizon3.ai.2.5 No Sharing of Private or Sensitive Information
Do not share your own or anyone else’s personal or sensitive information (including but not limited to phone numbers, email addresses, account credentials, physical addresses, government identifiers, or financial information) in public Community spaces. Do not share confidential, proprietary, or export‑controlled information belonging to your employer, customers, or any third party, unless you have all rights and authorizations necessary to do so and such sharing is appropriate for a public forum. If you need to share logs, configuration details, or screenshots, make sure to remove or redact any sensitive information before posting.2.6 Security and Responsible Behavior
Discussions involving security testing, vulnerability research, attack techniques, or exploitation must be educational and responsible. Do not share proof‑of‑concept code, exploit details, or techniques that would reasonably and directly enable unauthorized access, exploitation, or harm, except in a controlled and responsible manner consistent with applicable law. Do not directly encourage other Community members to attack or test systems they are not authorized to test. Any references to testing must clearly emphasize proper authorization and adherence to legal and contractual obligations. Do not attempt to compromise, probe, or test the security of the Community platform itself or of any Horizon3.ai systems, except as expressly authorized in writing by Horizon3.ai under a separate agreement.3. User Content and License
- User Content. The Community may allow you to post content such as comments, questions, answers, code snippets, scripts, configurations, documentation, ideas, or other materials (“User Content”). You are solely responsible for your User Content and for ensuring that it complies with these Community Terms and all applicable laws.
- Ownership. As between you and Horizon3.ai, you retain any ownership rights you may have in your User Content. You represent and warrant that you have all rights necessary to post your User Content and to grant the license described below.
- License to Horizon3.ai. By posting or otherwise making User Content available in the Community, you grant Horizon3.ai a worldwide, royalty‑free, non‑exclusive, perpetual, irrevocable, sublicensable and transferable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in connection with operating, improving, promoting, and supporting the Community, our products and services, and Horizon3.ai’s business (including in documentation, blog posts, marketing materials, and derivative knowledge resources).
- License to Other Users. You also grant each other Community user a non‑exclusive license to access and use your User Content through the Community, and to reproduce, adapt, and create derivative works from it for their own internal business or personal, non‑commercial purposes, subject to these Community Terms and any additional license terms you may clearly state in your post.
- Feedback. If you provide any suggestions, enhancement requests, recommendations, or other feedback regarding Horizon3.ai’s products, services, or the Community (“Feedback”), Horizon3.ai may use such Feedback for any purpose without restriction or obligation to you, and you hereby assign to Horizon3.ai all right, title, and interest in and to such Feedback.
4. No Support, No Warranties, and Disclaimers
- Informational Use Only. Content in the Community (including any User Content, posts by Horizon3.ai personnel, and any sample configurations or scripts) is for general informational purposes only and does not constitute professional advice (including legal, security, or compliance advice) or a binding support commitment.
- No Reliance. You are solely responsible for evaluating and testing any information obtained through the Community before relying on it or implementing it in your environment. Neither Horizon3.ai nor any Community participant can be held responsible for any negative consequences, including security incidents, service interruptions, or data loss, resulting from the use of information obtained from the Community.
- No Warranties. THE COMMUNITY, INCLUDING ALL CONTENT MADE AVAILABLE THEREIN, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. HORIZON3.AI SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT, AND ALL WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
- No Service Commitments. Participation in the Community does not create any service level, availability, response time, or support obligations on the part of Horizon3.ai. Any formal support or services are governed exclusively by the applicable contracts and support policies between you (or your organization) and Horizon3.ai.
5. Moderation and Enforcement
- Moderation. The Community may be moderated by Horizon3.ai employees, contractors, or designated moderators (collectively, the “Community Team”). The Community Team may monitor activity, review content, and enforce these Community Terms at any time and in its sole discretion.
- Moderator Actions. Without limiting any other rights of Horizon3.ai, the Community Team reserves the right, at any time and without prior notice, to: edit, move, hide, or remove any User Content that violates these Community Terms or is otherwise inappropriate; and restrict, suspend, or terminate your access to some or all of the Community, or to specific features, if we determine that your conduct violates these Community Terms or applicable law, or poses a risk to other users, Horizon3.ai, or any third party.
- No Public Discussion of Moderator Actions. You may not publicly discuss or dispute specific moderation actions. If you disagree with an action taken, you should contact the Community Team privately through the channels identified in the Community or by emailing community@horizon3.ai.
- Reporting Issues. If you have questions, encounter issues, or wish to report a violation of these Community Terms, please contact us at community@horizon3.ai.
6. Cookies, Tracking, and Analytics
- Cookies and Similar Technologies. The Community may use cookies and similar tracking technologies. Cookies are small text files stored on your device that allow us and our partners to recognize your browser and gather certain information about your use of the Community. Cookies used in connection with the Community do not store passwords or highly sensitive personal data but may collect information such as device identifiers, browser type, pages visited, and session duration.
- How We Use Cookies. We use cookies and similar technologies to: enable basic functionality of the Community (for example, login, session management, and preferences); understand how the Community is used and to help us improve content, navigation, and performance; and support security measures and detect fraudulent or abnormal activity in connection with the Community.
- Cookie Settings and Choices. Depending on how the Community is deployed, you may be able to manage your cookie preferences through a cookie banner or setting available in the Community interface or on the Horizon3.ai website. You may also control cookies through your browser settings by blocking or deleting cookies. Please note that if cookies are disabled, some Community features may not function properly.
- Tracking and Analytics. We may use internal analytics tools and/or third‑party analytics services to collect information about how the Community is used, such as the pages visited, time spent, and features accessed. We use this information to operate, maintain, secure, and improve the Community, and to better understand how users interact with Horizon3.ai resources. We do not sell this information to third parties.
- Privacy Policy. For additional details about our data collection and use practices, including your choices, please refer to our Privacy Policy.
7. Third‑Party Services, Links, and Content
- Third‑Party Links. The Community may contain links to third‑party websites, content, or services that are not owned or controlled by Horizon3.ai. Horizon3.ai is not responsible for, and does not endorse, such third‑party sites or services. Your use of any third‑party site, content, or service is subject to that third party’s own terms and privacy policies.
- Third‑Party Integrations. The Community may integrate with third‑party tools, such as identity providers, file sharing tools, or collaboration platforms. Use of those tools may require you to agree to additional terms and conditions presented by the third party.
8. Suspension, Termination, and Changes
- Suspension or Termination. Horizon3.ai may suspend or terminate your access to the Community at any time, with or without cause, and with or without notice, including for violation of these Community Terms, suspected fraudulent or abusive activity, or to comply with legal or regulatory requirements.
- Changes to the Community. Horizon3.ai may modify, discontinue, or restrict all or part of the Community (including specific features, content, or community spaces) at any time without liability to you or any third party.
- Changes to These Community Terms. Horizon3.ai may update these Community Terms from time to time. If we make material changes, we will provide notice (for example, by posting an updated version with a revised “Last Updated” date, by email, or through the Community). Your continued use of the Community after the effective date of any changes constitutes your acceptance of the updated Community Terms.
9. Data Protection and Privacy
- Processing of Personal Data. Horizon3.ai processes personal data in connection with the Community in accordance with our Privacy Policy and, where applicable, any data processing agreements or terms in place between Horizon3.ai and your organization.
- Public Nature of Community Content. Please be aware that information you post in public Community areas may be visible to other Community users and, in some cases, to the general public. Do not post personal data or other information that you do not wish to be publicly available.
- Data Subject Rights. Depending on your jurisdiction, you may have certain rights regarding your personal data (such as access, correction, deletion, or objection). Requests to exercise such rights should be submitted in accordance with our Privacy Policy.
10. Limitation of Liability
- Limitation. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HORIZON3.AI BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE COMMUNITY, EVEN IF HORIZON3.AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES WERE OTHERWISE FORESEEABLE.
- Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HORIZON3.AI’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE COMMUNITY OR THESE COMMUNITY TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
- Exclusions. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, HORIZON3.AI’S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Governing Law and Dispute Resolution
- Governing Law. These Community Terms are governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice or conflict of law provision or rule that would result in the application of the laws of any other jurisdiction.
- Venue. Any legal suit, action, or proceeding arising out of or related to these Community Terms or your use of the Community will be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in San Francisco County, and you hereby irrevocably submit to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.
12. General Provisions
- Entire Agreement. These Community Terms, together with the Site Terms and any other policies or terms referenced herein, constitute the entire agreement between you and Horizon3.ai regarding your use of the Community and supersede any prior or contemporaneous understandings, whether written or oral, relating to the same subject matter.
- Severability. If any provision of these Community Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal, or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
- No Waiver. No failure or delay by Horizon3.ai in exercising any right or remedy under these Community Terms will operate or be construed as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other or further exercise of any other right or remedy.
- Assignment. You may not assign or transfer these Community Terms, or any rights or obligations hereunder, by operation of law or otherwise, without Horizon3.ai’s prior written consent. Horizon3.ai may freely assign or transfer these Community Terms without restriction. Any attempted assignment in violation of this Section is null and void.
